On September 19, 2025, the President issued a proclamation imposing new restrictions on the H-1B visa program, a pathway traditionally used by highly skilled foreign workers. Under this change, new H-1B petitions must include a $100,000 fee in order to be accepted.
The policy took effect September 21, 2025, and applies only to new petitions. It does not affect:
- Workers who already hold valid H-1B visas
- Petitions filed before the effective date
- Beneficiaries of approved petitions
The $100,000 fee is a significant barrier, especially for smaller businesses and startups. While larger companies may absorb the cost, many employers may reconsider whether to pursue H-1B sponsorship at all.
